Proposed CMS Rule Changes for the 2027 Plan Year

Same-Day Educational and Marketing Events

CMS has proposed eliminating the current 12-hour separation requirement between educational and marketing events.

If finalized, Medicare Advantage agents would be permitted to host an educational event and immediately follow it with a compliant marketing event, provided attendees have the opportunity to opt out.

The 48-Hour Scope of Appointment (SOA) Rule Could Be Eliminated

One of the most anticipated proposals removes the mandatory 48-hour waiting period after completing a Scope of Appointment (SOA).

If approved, agents could conduct appointments immediately after obtaining a compliant SOA.

SOAs Could Once Again Be Collected at Educational Events

CMS has also proposed allowing agents to collect Scope of Appointment forms during educational events.

TPMO Disclaimer Requirements May Become Simpler

CMS is proposing updates to the Third-Party Marketing Organization (TPMO) disclaimer requirements by:

  • Eliminating the mandatory SHIP reference
  • Allowing the disclaimer immediately before discussing plan benefits

If finalized, these changes would allow conversations to flow more naturally while maintaining compliance.


 

Shorter Call Recording Retention Requirements

CMS has proposed reducing the required retention period for recorded sales calls.

Current Requirement

  • 10 years

Proposed Requirement

  • 6 years (or potentially less if future guidance changes)

This proposal would significantly reduce storage costs and administrative burdens for agencies and FMOs.


 

More Flexibility in Medicare Marketing Language

CMS is also considering allowing the use of superlative terms such as:

  • Best
  • Top-rated
  • Leading

These terms would still need to be truthful, substantiated, and not misleading to Medicare beneficiaries.

If approved, agents would gain additional flexibility when creating compliant advertising and marketing materials.


 

Proposed Rules Are Not Final

It is important to remember that all of the regulatory updates above are proposed changes.

CMS may:

  • Approve them as written
  • Modify them
  • Delay implementation
  • Remove them entirely

2027 Medicare Agent & Broker Compensation Updates

CMS has also announced updated maximum Medicare Advantage and Medicare Part D broker compensation amounts that become effective for Contract Year 2027.

These updated commission schedules establish the maximum allowable compensation. Individual insurance carriers may choose to pay different commission amounts according to their producer agreements.
